Terms of Use

The terms for using the fictional examples and browser demonstrations in the synthetic public beta.

1

Acceptance of terms

By accessing or using SurveyMarkup, you agree to these Terms of Use and our Privacy Policy.

2

Who operates SurveyMarkup

SurveyMarkup is operated by Tim Albash, sole trader, ABN 50 427 523 590. The operator is based in Queensland, Australia and is not currently registered for GST.

3

Synthetic public beta

The current public release is limited to bundled fictional examples and browser demonstrations. Features, outputs and availability may change as the product develops.

4

Assistance tool only

SurveyMarkup supports review organisation only. Professional judgement, statutory assessment and legal boundary determination remain outside the software workflow.

5

Professional decision boundary

Outputs are advisory working materials. Every professional decision and sign-off remains with the appropriately registered surveyor.

6

No customer-file intake

Do not upload, email, attach or paste a real client file. Server-side customer-file intake is disabled, and workflow interviews use the fictional worked example only.

7

User responsibility

Users are responsible for checking source data, settings, coordinate systems, exports and final outputs before any professional use.

8

Existing accounts

Any existing account is personal to the invited user or firm. Keep sign-in credentials secure and tell us promptly if you believe an account has been accessed without authorisation.

9

No active payment offer

No public payment, support-payment, prepaid membership, subscription or review-service offer is active in the synthetic public beta. The public offer and legal terms must be updated before any payment path is activated.

10

Intellectual property

SurveyMarkup, including its software, branding and site content, is owned by SurveyMarkup or its licensors. Fictional demonstration material may be used only as part of the public product experience unless a separate licence permits more.

11

Acceptable use

Do not misuse the service, attempt to disrupt it, seek unauthorised access, bypass disabled intake controls or submit content you do not have the right to process.

12

Public standards

SurveyMarkup references public surveying standards — including GDA2020, GDA94, MGA, AUSGeoid and AHD — for compatibility only. SurveyMarkup claims no ownership of, and no authority over, those standards. A registered surveyor must confirm the applicable requirements and every result before reliance.

13

Limitation of liability

To the maximum extent permitted by law, SurveyMarkup and its providers are not liable for indirect, incidental or consequential loss from use of the service.

14

Your consumer rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.

15

Governing law

These terms are governed by the laws of Australia, and you submit to the courts of Australia for any dispute, without affecting any non-excludable rights you have in your own jurisdiction.
